These Terms of Service govern your access to and use of the Ecomsy website and every service we deliver. By browsing the site, requesting a quote, or engaging us on a project, you agree to what follows.
Ecomsy (SMC-PRIVATE) LIMITED is a registered software house, e-commerce agency and training institute based in Pakistan, working with clients across Pakistan, the Gulf, the United Kingdom, Europe and North America. Wherever you are, these terms form the baseline of our working relationship.
Where a signed project agreement, statement of work or written quote exists, that document takes precedence over anything here for the specific project it covers. Think of these terms as the foundation, and your project agreement as the detail built on top of it.
Ecomsy delivers digital products and the services that surround them. Each engagement is defined by its own written scope, so you always know exactly what is included before work begins.
Business websites, custom-coded platforms, Shopify stores and WordPress or WooCommerce builds, including migrations, integrations and performance work.
Android and iOS applications, cross-platform builds, bespoke business software, CRM and ERP systems, dashboards, automations and API work.
UI and UX design, design systems, brand identity, visual direction and the production assets needed to launch and stay consistent.
Search engine optimisation, paid campaigns across Meta, Google and TikTok, analytics, conversion work and content support.
Structured courses, mentorship programmes and certification through our learning portal, with their own enrolment terms where applicable.
Maintenance retainers, security updates, hosting guidance, monitoring and the ongoing improvements that keep a product healthy after launch.
Anything not explicitly listed in your project agreement is out of scope. That is not a technicality to catch you out, it simply keeps expectations clear on both sides. Additional work is always quoted and approved before it starts.
Every engagement follows the same predictable path. Knowing the shape of it up front removes most of the friction that derails software projects.
We map what you need, agree the deliverables and produce a written quote with milestones, timelines and assumptions stated plainly. Nothing begins until you approve it.
You review designs or prototypes at defined checkpoints. Each stage includes a set number of revision rounds, listed in your agreement, so feedback has a clear home.
Development runs against the agreed milestones with regular updates. Where a project needs your input or content, we flag it early because those items usually drive timelines.
We test across devices and browsers, fix what we find, then hand over the deliverables along with any access, documentation or training your agreement includes.
Post-launch we correct defects in delivered work for the period stated in your agreement, at no extra cost. New features and changes of direction are quoted separately.
Projects move at the speed of feedback. Timely responses, timely content and a single decision-maker on your side are the three things that most reliably keep a project on schedule. Where delays come from your side, timelines shift accordingly and we will always tell you before that happens.
We price transparently and bill against milestones you have already agreed. There are no hidden fees and no charges that appear after the fact.
You may cancel a project in writing at any time. Work completed and hours committed up to the cancellation date remain payable, and any amount paid beyond that is refunded. Deposits covering work already performed are non-refundable. Where we cannot deliver what was agreed, we refund the affected milestone in full.
This is the clause most often written to confuse. Ours is deliberately simple: once you have paid in full, the work is yours.

We may display completed work in our portfolio, case studies and marketing, using your name and logo, unless you ask us not to. A written request to keep a project private is always honoured, and confidential projects can be covered by an NDA before work begins.
Good projects rest on clear obligations. Here is what you can expect from us, and what we rely on from you.
You agree not to attempt unauthorised access to our systems, probe or scan our infrastructure, scrape content at scale, upload malicious code, misrepresent your identity, or use the site in a way that disrupts service for others. We may suspend access where this occurs.
Every agreement needs limits. These are ours, stated as clearly as we can put them.
We warrant that services are performed with reasonable skill and care, and that delivered work will substantially match the agreed scope. We do not warrant uninterrupted or error-free operation, nor specific commercial outcomes such as rankings, traffic or revenue.
To the fullest extent permitted by law, Ecomsy is not liable for indirect, incidental or consequential losses, including lost profits, lost data or business interruption. Our total aggregate liability is limited to the fees you paid for the project giving rise to the claim.
Products often rely on services we do not control, such as hosting, payment gateways, app stores and APIs. We integrate them carefully but are not responsible for their outages, pricing changes, policy decisions or discontinuation.
Either party may end an engagement in writing. Amounts for work completed remain payable, and each side returns or deletes the other's confidential materials on request. Clauses on ownership, confidentiality and liability survive termination.
These terms are governed by the laws of Pakistan, and the courts of Pakistan have jurisdiction over any dispute. Where you contract with us from another country, this does not remove consumer rights you hold locally that cannot be waived.
If something goes wrong, talk to us first. Almost every disagreement is resolved by a direct conversation about expectations. We commit to engaging in good faith before either side escalates a matter formally.

Yes. Once your project is paid in full, ownership of the final deliverables transfers to you, including the code written specifically for your project. The only exceptions are third-party components, which keep their own licences, and our pre-existing frameworks, which you receive a perpetual licence to use within the delivered product.
Defects in work we delivered are fixed free of charge during your support window. New features, design changes or scope beyond the original agreement are quoted separately, and we always give you the price before starting. Many clients move onto a maintenance retainer so improvements have a predictable monthly budget.
You can, in writing, at any time. You pay for work completed and hours committed up to that point, and anything you have paid beyond that is refunded. We will hand over whatever has been produced so far so you are never left with nothing for your money.
Yes, and we do so regularly before discovery calls where sensitive detail is involved. We also keep your credentials and business information confidential by default, whether or not an NDA is in place. If you would prefer your project stays out of our portfolio, just tell us and we will honour that permanently.
US dollars by default, since most of our clients are international. We can also invoice in two other major currencies, GBP and EUR, on request. Card payments are processed securely by Stripe, which may convert to your local currency at checkout, and you can track any invoice at ecomsy.com.pk/invoice using its reference.
It happens on almost every project and it is not a problem. Timelines shift to reflect the delay, and we tell you as soon as we see it coming rather than letting a deadline quietly pass. Where a project is paused for an extended period, we may need to re-schedule the remaining work around other commitments.
